These Terms of Service ("Terms") govern your use of xespool.com and any official XES mobile application ("XES", "the service", "we", "us", "our"). By using the service you agree to these Terms. If you do not agree, please do not use the service.
XES is a United Kingdom based service. Our Privacy Policy explains how we handle the limited information involved in using the service.
XES operates a random voice and video chat website at xespool.com. Voice and video calls are made directly between users (peer-to-peer). We do not record or store the contents of calls. You can reach us at admin@xespool.com.
You must be at least 18 years old to use XES. The service is not intended for, and may not be used by, anyone under 18. At first launch you are required to confirm your age in a clear, blocking dialog; by ticking that confirmation, and by continuing to use the service, you affirm that you are 18 or over and have the legal capacity to enter into these Terms.
If we become aware that a user is under 18, their account will be terminated and any associated email address will be deleted. We may verify age where the law requires it.
You may use XES without an account, or you may choose to create an account by providing an email address. If you create an account:

XES connects you with another user, at random or based on basic preferences (such as country), for a voice or video conversation. Conversations are intended to be anonymous — do not share personal, financial, or sensitive information with people you meet on the site.
The service is provided on a best-effort basis. We may add, change, suspend, or remove features at any time and may take the site offline for maintenance or for any other reason without notice.
XES operates a zero-tolerance policy on objectionable content and abusive behaviour. When using XES you agree that you will not:
Breaking any of the above may result in immediate and permanent termination of your account without notice or appeal, and where the law requires it, in a report to the relevant authorities.
XES provides in-app tools to keep the service safe:
We aim to review reports of objectionable content or abusive behaviour within 24 hours. Depending on the severity, action may include a trust penalty, a temporary cooldown, a temporary ban, or a permanent ban. Permanent bans also delete the email address linked to the banned account.
We may also act on our own initiative where we identify a breach of these Terms or the law, without waiting for a user report. We are not obliged to investigate every report and may act on reports without prior notice to either party.

You are solely responsible for what you say, show, and share during a call. Because calls are peer-to-peer and not recorded by us, we cannot retrieve, review, or recover the content of any past conversation. Anything you choose to disclose to another user is at your own risk.
The service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties or representations about the site or its availability, accuracy, suitability, or freedom from interruption, errors, or harmful content from other users.
Nothing in these Terms limits or excludes any rights you have as a consumer that cannot be limited or excluded under the Consumer Rights Act 2015 or other applicable UK law.
To the fullest extent permitted by law, XES is not liable for any loss or damage arising from:
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited by UK law.
The XES name, logo, website design, and software are owned by us or our licensors and are protected by intellectual property laws. You may use the site for personal, non-commercial use only. You may not copy, modify, distribute, resell, or reverse engineer any part of the site without our prior written permission.
We may suspend or terminate your access to XES at any time, with or without notice, if we believe you have broken these Terms or if we need to do so to protect the service or other users. You may stop using XES at any time. Sections of these Terms that by their nature should survive termination (including liability, intellectual property, and governing law) will continue to apply.
We may update these Terms from time to time. The "Last updated" date at the top of the page shows when they were most recently revised. Continued use of the site after a change means you accept the updated Terms.
These Terms and any dispute or claim arising out of them (including non-contractual disputes or claims) are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in your local courts.
These Terms also apply to any official XES mobile application made available through the Apple App Store, Google Play, or other distribution channels. References to "the site" should be read as including the mobile application where the context allows.
If you obtained the XES mobile application from the Apple App Store, you also acknowledge and agree to the following:
The Apple Standard EULA, available at apple.com/legal/internet-services/itunes/dev/stdeula/, also applies to your use of the application where it is downloaded from the App Store, to the extent it is not inconsistent with these Terms.
If you obtained the XES mobile application from Google Play, you acknowledge that Google is not a party to these Terms and is not responsible for the application or its content, but may act as a third-party beneficiary to enforce the relevant provisions on its own behalf.
